A man is now free to make a personal injury claim after an NHS Trust has admitted liability for the brain damage he now suffers with.
The NHS Trust has accepted that their mistakes led to the brain damage and this means that the victim is able to make a personal injury claim against the hospital.
The man was left brain damaged following surgery that went wrong. And it was revealed after the brain surgery took place that the surgery was unnecessary anyway.
During the surgery, a biopsy of a tumour was taken; but a part of healthy brain was taken by mistake and it was discovered that the tumour was benign and could have been dealt with by tablets.
Because of the mistake made, the man has to have care 24 hours a day and he needs constant supervision. He suffers from memory loss and has also suffered loss of sight.
Before this happened, the victim lived an active life and so the incident has really changed him; it’s made more difficult for family to cope with, knowing that it could all have been avoided.
